AI is Now a Compliance risk. Most Organisations Are Not Ready

With full EU AI Act enforcement arriving in August 2026, and regulators on both sides of the Atlantic treating AI governance as an operational risk priority, the window for a relaxed approach has closed. The question is no longer whether to act, it’s is whether you are already too late.
For the past two years, AI compliance risk has felt like something on the horizon, important, but not yet urgent. That is no longer a credible position to take. The EU AI Act has been rolling out in phases since it entered into force in August 2024 and prohibited AI practices became enforceable in February 2025. Obligations for general-purpose AI models followed in August 2025. And on 2nd August 2026 the rules governing high-risk AI systems come into full effect, carrying fines of up to 15 million euros or 3% of global turnover for non-compliance.
In the United States, the picture is fragmented but no less pressing. With no federal AI law in place, more than 40 states have introduced active AI compliance risk legislation, with Texas and California laws already live. The SEC has elevated AI governance to a top examination priority for 2026, explicitly linking it to cybersecurity risk and operational disclosures. FINRA has named agentic AI supervision as its emerging focal point. The message from regulators is consistent and unambiguous: document your AI systems, classify their risks, and be prepared to evidence your governance.
For many technology leaders, this is a wake-up call. A recent Compliance Week survey found that 83% of organisations are already using AI tools in some capacity, yet only 25% have implemented even moderate governance frameworks. That gap is not just a compliance problem. It is a board-level liability just waiting to surface.
How AI Compliance Risk Matters Differently Across Sectors
Fintech
The regulated nature of financial services means that fintech CIOs and CISOs arguably face the most acute exposure. AI is increasingly embedded in credit decisioning, fraud detection, customer onboarding, and transaction monitoring, all of which fall squarely into the EU AI Act’s high-risk category. The SEC’s shift in focus from crypto to AI governance signals that financial services firms should expect intensive scrutiny of how AI is used for internal decision-making and client-facing functions alike. Enforcement actions in this space are a matter of when, not if.
Retail
Retail faces a different but equally significant set of pressures. Retailers have been among the earliest adopters of AI for pricing, enhancing customer experience and fraud prevention often without realising that some of these applications are caught by the AI Act’s transparency and risk classification requirements. The compliance burden that once fell only on large corporations is now landing on mid-market retailers, and many are not structured to absorb it.
Manufacturing
For manufacturing, the challenge is often less visible but no less real. AI embedded in industrial processes, quality control systems, and supply chain management creates third-party risk that manufacturers inherit whether they realise it or not. Geopolitical tensions and tariff instability have already forced significant rethinking of supplier relationships. Adding AI compliance due diligence to vendor onboarding is now a practical necessity. If your supplier is using AI to manage a process that affects your output, their governance failure becomes your regulatory exposure.
The CISO Has Become The AI Compliance Risk Lead
One of the most significant structural shifts underway is the expansion of the CISO role into AI governance. A 2026 report from IANS Research found that more than 90% of organisations do not allow blanket access to AI applications, with the majority of CISOs now actively managing AI tool allowlists and enforcing usage policies across their organisations. Half of businesses have established dedicated AI governance committees, and in most cases the CISO sits at the centre of them.
This makes sense in principle. CISOs have deep technical knowledge, the risk management instinct, and the cross-functional relationships needed to lead AI governance effectively. But the pace of AI adoption has outrun the maturity of the governance tooling available. The 2026 CISO AI Risk Report, based on responses from over 200 senior security leaders across the US and UK, found that nearly half of organisations have already observed AI agents exhibiting unintended or unauthorised behaviour. A third dealt with an actual security incident or near-miss involving AI in the past year. And only 16% say that AI access is governed effectively, even though AI tools routinely hold system-level access that would never be granted to a human user.
The governance infrastructure built for human identity and access management does not automatically extend to AI agents and models. CISOs who are ahead of the AI compliance risk curve are building AI-specific identity governance, continuous monitoring, and real-time privilege enforcement. Those who are not are, in effect, running open-ended access for systems they cannot fully audit. That is not a risk posture. It is an incident waiting to happen.
The AI Washing Problem Nobody Is Talking About
There is a quieter compliance risk emerging alongside the more visible governance challenges, and it deserves more attention than it currently receives. AI washing is the practice of claiming that products or services are AI-powered when they are not, or overstating the nature of AI capabilities to customers, investors, or regulators. The SEC has made clear that AI washing carries the same compliance exposure as greenwashing: false and misleading statements, governance failures, and serious reputational damage.
As AI becomes a commercial differentiator the temptation to overstate AI capabilities in procurement discussions, investor communications, and marketing materials is real and growing. CIOs need to ensure that their organisations’ external claims about AI are accurate, documented, and defensible. Legal and compliance teams need to be involved in AI marketing sign-off, not as a formality, but as a genuine risk control. This is not a niche concern. It is an area where enforcement exposure is building quietly, and the consequences of getting it wrong are substantial.
Three Actions That Leaders Should Take Before August
- Build your AI inventory now. Every AI system, tool, and agent in use across your organisation needs to be catalogued, classified by risk, and assigned a clear owner. This includes shadow AI (tools that employees are using without formal approval). The CISO Pulse Check Report 2026 found that only 21% of organisations have controls in place to prevent sensitive data from being uploaded to public AI platforms. That figure alone should prompt urgent remediation.
- Treat AI governance as compliance infrastructure, not a policy exercise. Regulators have been explicit: documented policies are not sufficient. They expect risk classifications, third-party due diligence, model lifecycle controls, and measurable key risk indicators. If your AI governance programme exists only on paper, it will not survive an audit. The organisations investing in enforcement capability — not just intent — will be the ones that emerge from this period with both regulatory standing and competitive advantage.
- Integrate AI risk into your vendor management framework. Third-party AI risk is inherited risk. Whether you are a fintech relying on an AI-powered KYC provider, a retailer using an AI demand forecasting platform, or a manufacturer deploying AI-enabled quality tools from a supplier, you need contractual audit rights, data handling clarity, and compliance evidence from every AI vendor in your chain. This is not optional under the AI Act — and it is increasingly a prerequisite for cyber insurance coverage.
